A partition of real property can be either (1) the physical division of a piece of land by the court or (2) the division of proceeds after the court orders the sale of a piece of land. A real estate partition is an option where multiple property owners disagree on how to use the land that they share title to. Each individual has a right to full use and enjoyment of land, and that can be very difficult if the parties cannot reach an agreement on their own.
