Our office can assist you with the preparation of the following non-transaction related transfers of property:
Gift Deeds - Transfers between individuals where no money is exchanging hands. The purpose of this transfer is to gift a piece of real property.
Quitclaim Deeds - A “blanket” transfer of all of your rights, both actual and potential, to a piece of real property without money exchanging hands. It is most common to use a quitclaim deed when transferring title between spouses, into a trust, or to prevent the transferor from having any potential future adverse claim against title.
Joint Tenants with Rights of Survivorship Deeds - This deed ensures that title immediately vests in the surviving owner upon the other owner’s death without having to go through probate. In order to avoid probate, your deed must contain this specific language. It is an excellent estate planning tool and is most commonly seen with married couples.
Deeds of Distribution - Our office can assist with the transfer of property out of a deceased individual’s probate estate. We will prepare the deed that confirms title into the name of the will beneficiary or in the name of the heirs-at-law if the deceased individual did not have a will.
Deeds-in-Lieu of Foreclosure - Our office can assist with the transfer of property from a mortgagor back to the mortgage holder in the event of default. A deed-in-lieu of foreclosure is a way for the mortgage holder to obtain title to the collateral real property without having to go through a foreclosure proceeding.
