Many businesses have the need for a variety of contracts with other businesses, with suppliers, sales representatives, employees, or governmental agencies. Under South Carolina law, if there is litigation over a business contract, the job of the courts is not to rewrite the contract, but rather to enforce the terms of the contract as expressed in the written document. Unless the language in the contract is ambiguous, no outside testimony or evidence as to the parties’ intention is allowed at the trial. A well drafted contract can thus increase your likelihood of success if you ever have to go to court.
